These Terms of Service (“Terms”) are a legally binding agreement between you and qLabs LLC, doing business as Homeway.io (“Homeway,” “we,” “us,” or “our”). These Terms govern your access to and use of Homeway.io, the Homeway add-on, Homeway cloud relay services, Homeway integrations, Supporter Perks, referral programs, websites, software, APIs, documentation, and related services (collectively, the “Services”).
By creating an account, installing or using the Homeway add-on (or app), connecting a Home Assistant instance, starting a subscription, using Supporter Perks, using a referral link, or otherwise accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Homeway is a best-effort remote-access and smart-home service. We work hard to keep it reliable and secure, but we do not provide any service-level agreement, uptime guarantee, security guarantee, data-loss guarantee, refund guarantee outside the refund policy below, or guarantee that the Services will always be available, error-free, uninterrupted, or secure. You are responsible for your Home Assistant instance, your devices, your automations, your credentials, your network, your account security, and what happens when you use remote access or smart-home control features.
You may use the Services only if you are at least the age of majority in your jurisdiction and have the legal authority to enter into these Terms. If you use the Services on behalf of a company, organization, household, or other entity, you represent that you have authority to bind that entity, and “you” includes both you and that entity.
You are responsible for maintaining the confidentiality and security of your account credentials, authentication tokens, API keys, Home Assistant credentials, connected-service credentials, devices, local network, and any email account or identity-provider account used to access Homeway. You are responsible for all activity that occurs through your account, whether authorized by you or not, except to the extent caused by Homeway’s willful misconduct where liability cannot be limited by law.
You agree to use strong passwords, keep your devices and Home Assistant instance updated, secure your local network, avoid credential reuse, and promptly notify us if you believe your account, credentials, Home Assistant instance, add-on, network, or connected devices have been compromised.
Homeway is not responsible for losses, access, changes, damage, disclosure, device actions, automation actions, or other consequences resulting from your disclosure of credentials, leaked credentials, weak passwords, compromised email accounts, compromised identity-provider accounts, malware on your devices, insecure local networks, misconfigured Home Assistant instances, exposed secrets, shared links, shared devices, third-party integrations, or other circumstances outside Homeway’s reasonable control.
The Services may enable remote access to, communication with, or control of your Home Assistant instance, local network, smart-home devices, automations, integrations, cameras, sensors, locks, doors, lights, climate systems, appliances, garage doors, alarms, or other connected systems. You understand and agree that smart-home systems can affect physical spaces and physical devices.
You are solely responsible for your Home Assistant configuration, connected devices, automations, scripts, scenes, permissions, users, exposed entities, network configuration, device safety, and compliance with applicable laws. You assume all risk associated with remote access and smart-home control, including unauthorized access, accidental commands, automation failures, device failures, property damage, personal injury, data loss, privacy exposure, and service interruptions.
To the maximum extent permitted by law, Homeway disclaims responsibility and liability for any harm, damage, loss, claim, or expense arising from or related to your Home Assistant instance, local network, connected devices, automations, integrations, exposed services, remote commands, third-party services, or use or misuse of the Services.
Homeway may offer a cloud-hosted Model Context Protocol server, AI tool server, automation bridge, assistant integration, or similar feature that allows AI systems, large language models, agents, assistants, third-party applications, or other automated systems to access, read, control, edit, modify, create, delete, or operate parts of your Home Assistant instance, integrations, entities, devices, automations, scripts, scenes, configuration, connected services, or related smart-home systems (collectively, the “MCP Features”).
By enabling, connecting, authorizing, authenticating, configuring, or using any MCP Feature, you acknowledge and agree that you are intentionally granting automated systems the ability to interact with your Home Assistant environment and connected systems. You are solely responsible for deciding whether to enable MCP Features, which Home Assistant instances are connected, which entities or tools are exposed, which permissions are granted, which AI providers or assistants are connected, which commands are allowed, and whether the MCP Features are appropriate for your use case.
MCP Features may allow AI systems or automated agents to perform actions including, without limitation, turning devices on or off, changing climate settings, opening or closing covers or garage doors, modifying automations, editing configuration, triggering scripts or scenes, accessing device states, reading logs, creating or deleting Home Assistant objects, calling services, controlling integrations, interacting with connected cloud services, and taking other actions available through the permissions, tools, entities, integrations, or credentials you expose.
AI systems and automated agents can be unpredictable, incorrect, incomplete, unsafe, manipulated, or misunderstood. MCP Features may result in unintended, unauthorized, unsafe, destructive, or harmful actions, including actions caused by prompt injection, malicious instructions, compromised accounts, exposed tokens, incorrect tool descriptions, model hallucinations, model mistakes, ambiguous commands, third-party AI-provider behavior, integration bugs, Home Assistant bugs, user configuration errors, permission misconfiguration, automation loops, delayed execution, repeated execution, missing context, stale state, or other failures.
You assume all risk arising from or related to MCP Features. To the maximum extent permitted by law, Homeway, qLabs LLC, and their owners, officers, employees, contractors, affiliates, agents, service providers, and licensors are not responsible or liable for any damage, harm, loss, claim, expense, or consequence arising from or related to any AI system, assistant, model, agent, application, user, third party, or automated process accessing, controlling, editing, modifying, deleting, triggering, or otherwise interacting with your Home Assistant instance, integrations, devices, automations, scripts, scenes, configuration, local network, connected services, accounts, data, or physical environment through or in connection with MCP Features.
This disclaimer includes, without limitation, any property damage, personal injury, device damage, network damage, data loss, data disclosure, privacy exposure, security incident, unauthorized access, incorrect device action, unsafe automation, deleted configuration, broken integration, service interruption, account suspension, third-party service action, financial loss, utility cost, energy cost, alarm event, lock event, garage-door event, climate-control event, appliance event, or other physical, digital, personal, financial, or operational harm.
You agree that MCP Features must not be used for emergency, life-safety, safety-critical, medical, security-critical, access-control-critical, or hazardous uses. You may not rely on MCP Features to protect people, animals, property, homes, buildings, equipment, or data. You are solely responsible for maintaining independent safety systems, physical safeguards, manual overrides, backups, access controls, monitoring, and fail-safe mechanisms.
You are responsible for reviewing, limiting, and monitoring all MCP permissions, exposed tools, exposed entities, authentication tokens, Home Assistant users, connected AI providers, third-party applications, and assistant access. You should expose only the minimum tools and entities necessary, avoid exposing dangerous controls, maintain backups of your Home Assistant configuration, and regularly review logs and account activity. Homeway is not responsible for your failure to restrict permissions, monitor usage, maintain backups, or secure connected systems.
You represent and warrant that you have all rights, permissions, and authority necessary to connect the MCP Features to your Home Assistant instance, local network, devices, integrations, accounts, and connected services, and to allow AI systems, assistants, agents, applications, and third-party providers to access or control them. You are responsible for obtaining consent from any household members, guests, tenants, employees, users, or other people whose devices, accounts, data, images, audio, presence information, location information, or privacy may be affected.
Homeway may provide technical controls, permission settings, confirmations, logging, rate limits, deny lists, allow lists, safety filters, or other safeguards for MCP Features, but we do not guarantee that such safeguards will prevent misuse, unauthorized access, harmful actions, incorrect actions, prompt injection, model errors, or other failures. Any safeguards are provided on a best-effort basis and do not create any warranty, duty, obligation, SLA, or guarantee.
MCP Features may transmit prompts, tool descriptions, tool results, device states, entity names, service-call results, logs, metadata, configuration details, and other information to Homeway, Home Assistant, AI providers, assistant platforms, third-party applications, or other connected services depending on your configuration. You are responsible for understanding and accepting the privacy, security, retention, and data-use practices of any third-party AI provider, assistant, model, application, or service you connect. Homeway is not responsible for the acts, omissions, outputs, retention practices, security practices, or data practices of third-party AI providers or applications.
We may suspend, restrict, throttle, disable, or terminate MCP Features or related account access at any time, with or without notice, if we believe the feature is being misused, creates security risk, creates operational risk, causes excessive load, violates these Terms, may harm users or third parties, may expose Homeway to liability, or is no longer technically, legally, commercially, or operationally reasonable to provide.
You agree to defend, indemnify, and hold harmless Homeway, qLabs LLC, and their owners, officers, employees, contractors, affiliates, agents, service providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use or misuse of MCP Features, your configuration of MCP Features, your exposed tools or entities, AI-generated actions, third-party assistant actions, connected provider actions, unauthorized access through your account or credentials, or any impact on your Home Assistant instance, integrations, devices, connected services, local network, data, household, property, or other people.
The Services are not designed, intended, certified, or guaranteed for emergency, safety-critical, medical, security-critical, or life-safety uses. You may not rely on the Services for fire detection, medical monitoring, emergency response, intrusion detection, access control, child safety, elder care, hazardous equipment operation, or any use where failure, delay, interruption, unauthorized access, or incorrect operation could lead to death, personal injury, property damage, or significant loss.
You may use the Services only for lawful remote access to and operation of a Home Assistant instance, devices, networks, and integrations that you own or are authorized to access. You may not use the Services to access, attack, scan, disrupt, compromise, reverse engineer, overload, resell, abuse, or interfere with Homeway, other users, third-party services, networks, devices, or systems.
You agree not to:
We may suspend, limit, or terminate your account or access to the Services at any time if we believe you have violated these Terms, created risk for Homeway, other users, third parties, or the Services, or used the Services in a way that may expose Homeway to legal, security, operational, financial, or reputational risk.
You are solely responsible for all data, commands, content, media, logs, messages, traffic, video, audio, device state, automations, and other information transmitted, accessed, stored, processed, or streamed through or in connection with the Services (“User Content”).
Homeway does not control and is not responsible for User Content, your Home Assistant instance, your local network, your connected devices, or third-party integrations. You represent and warrant that you have all rights and permissions necessary for User Content and for any device, system, network, or service you connect to Homeway.
We may remove, block, disable, report, or preserve User Content or account information if we believe it violates these Terms, creates risk, is unlawful, or is necessary to comply with law, legal process, security obligations, payment disputes, abuse prevention, or requests from law enforcement.
The Services are provided on a best-effort basis. We do not offer any service level agreement, uptime commitment, availability guarantee, response-time guarantee, support guarantee, data-delivery guarantee, data-retention guarantee, or security guarantee unless expressly stated in a separate written agreement signed by Homeway.
The Services may be unavailable, interrupted, delayed, degraded, limited, changed, suspended, or discontinued at any time, with or without notice, including due to maintenance, bugs, attacks, abuse, outages, third-party service failures, infrastructure failures, payment issues, business decisions, legal requirements, or circumstances outside our reasonable control.
You agree that service interruptions, degraded service, latency, data limits, feature changes, bugs, add-on issues, outages, security events, maintenance, discontinued features, or permanent shutdown of the Services do not entitle you to credits, refunds, damages, or other compensation except where required by law or expressly stated in these Terms.
We may modify, add, remove, limit, suspend, discontinue, or replace any part of the Services, including features, integrations, data limits, pricing, Supporter Perks, referral programs, infrastructure, add-ons, APIs, and third-party integrations. We are not obligated to maintain any feature, integration, compatibility, data, or content.
To protect the Services and manage costs, we may apply usage limits, bandwidth limits, rate limits, storage limits, API limits, abuse-prevention controls, or other restrictions to any account. Unless we state otherwise, accounts may be limited to 50 gigabytes of remote-access data transfer per month, including paid Supporter Perks accounts. “Unlimited” or similar descriptions mean that ordinary non-abusive use is not metered within the applicable fair-use limits; they do not remove anti-abuse, operational, or monthly data-transfer limits.
We may throttle, suspend, restrict, or terminate accounts that exceed limits, create unusual costs, degrade service, appear abusive, or pose security, operational, legal, or financial risk.
Supporter Perks are paid subscription features. By starting a Supporter Perks subscription, you authorize us and our payment processors to charge your selected payment method for recurring subscription fees, applicable taxes, and applicable fees at the billing interval and price disclosed at checkout, until you cancel.
Supporter Perks may be billed monthly, yearly, or on another disclosed billing cycle. Your subscription automatically renews at the end of each billing period unless you cancel before renewal. You can manage, upgrade, downgrade, or cancel your subscription from the Supporter Perks page at /supporter, or by contacting support@homeway.io.
If you cancel, your Supporter Perks will normally remain active until the end of the billing period you already paid for, unless we terminate or suspend your access under these Terms. Cancellation does not automatically entitle you to a refund except as expressly stated in these Terms or required by law.
Some Supporter Perks subscriptions may begin with a free or discounted trial. If a trial is offered, the trial length, renewal date, and subscription price will be disclosed at signup. Unless you cancel before the trial ends, your trial will convert to a paid recurring subscription and your payment method will be charged automatically.
We offer a one-time 30-day money-back refund window for a new Supporter Perks subscription. If your subscription begins with a trial, the 30-day refund window starts when the trial begins. If your subscription does not begin with a trial, the 30-day refund window starts when the subscription begins.
To request a refund during the refund window, contact us through the website chat widget or email support@homeway.io. If your first refund request is received during the refund window, we will grant the refund for the eligible initial subscription payment, subject to fraud, abuse, chargeback, payment-processor, and legal limitations.
Except for the 30-day refund window described above or where required by law, subscription payments, renewals, future billing-period payments, taxes, service fees, and other charges are non-refundable. This includes non-refundability for outages, bugs, add-on issues, degraded service, changed features, unavailable features, discontinued features, account misuse, account compromise, user error, incompatibility, or dissatisfaction after the refund window.
Prices, plans, features, limits, taxes, and fees may change over time. We may add or collect taxes, transaction fees, service fees, currency-conversion fees, payment-processor fees, or other applicable charges. For active subscriptions, material price changes will apply no earlier than your next renewal unless otherwise disclosed or permitted by law. Where required by law, we will provide advance notice of material subscription-price changes and information about how to cancel.
You are responsible for all taxes, fees, and charges associated with your subscription except taxes based on our income. If your payment fails, we may suspend, downgrade, or terminate your Supporter Perks or account.
Payments are processed by third-party payment processors. Homeway does not store full payment-card numbers in its own application databases. Payment processors may store and process your payment information under their own terms and privacy policies. We are not responsible for payment-processor failures, errors, breaches, outages, chargebacks, holds, or account actions except to the extent liability cannot be limited by law.
The Homeway referral program is optional and may be changed, limited, suspended, or discontinued at any time. Referral credits, rewards, eligibility rules, payout amounts, payout methods, fraud controls, and program requirements are determined by Homeway in its sole discretion.
Referral rewards are promotional credits unless and until Homeway approves an actual payout. Referral rewards have no cash value except where expressly approved by Homeway. We may deny, reverse, remove, withhold, or adjust referral rewards for suspected abuse, fraud, self-referral, duplicate accounts, fake accounts, chargebacks, payment failures, policy violations, technical errors, tracking failures, or any other reason permitted by law.
Unless otherwise stated, referral amounts are denominated in U.S. dollars. Referral credits may be applied to Supporter Perks charges. Cash payouts, if offered, may require identity verification, tax documentation, U.S. residency or citizenship eligibility, age verification, payment-account eligibility, and good standing. You are responsible for any taxes associated with referral rewards.
Abuse of the referral program may result in loss of credits, account suspension, account termination, denial of payouts, and any other remedies available to Homeway.
The Services, including software, websites, designs, text, graphics, logos, documentation, APIs, and related materials, are owned by Homeway, qLabs LLC, or their licensors and are protected by intellectual-property and other laws. These Terms do not transfer any ownership rights to you.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your own lawful personal or internal business use.

If you provide suggestions, ideas, bug reports, feature requests, or other feedback, you grant Homeway a perpetual, worldwide, irrevocable, royalty-free license to use, modify, publish, and exploit that feedback without restriction or compensation.
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that you have reviewed the Privacy Policy.
The Services may depend on or integrate with third-party services, including Home Assistant, cloud providers, payment processors, voice assistants, AI model providers, identity providers, DNS providers, email providers, app stores, and other services. We do not control third-party services and are not responsible for their actions, outages, terms, security, privacy practices, pricing, availability, or changes.
We use reasonable efforts designed to protect the Services, but no internet, cloud, smart-home, remote-access, authentication, or software system can be guaranteed to be secure. You acknowledge that unauthorized access, vulnerabilities, data exposure, credential compromise, malware, misconfiguration, third-party failures, and other security incidents may occur.
To the maximum extent permitted by law, Homeway is not liable for unauthorized access, account compromise, device access, data loss, data disclosure, network access, device actions, automation actions, or other security-related harms except to the extent caused by Homeway’s willful misconduct or where liability cannot be limited by law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” HOMEWAY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, RELIABILITY, COMPATIBILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.
HOMEWAY DOES NOT WARRANT THAT THE SERVICES WILL BE SECURE, AVAILABLE, UNINTERRUPTED, ERROR-FREE, COMPATIBLE WITH YOUR SETUP, FREE OF HARMFUL COMPONENTS, OR THAT DATA WILL BE PRESERVED, DELIVERED, OR RECOVERABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEWAY, QLABS LLC, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES; LOST PROFITS; LOST REVENUE; LOSS OF GOODWILL; LOSS OF DATA; DEVICE DAMAGE; NETWORK DAMAGE; PROPERTY DAMAGE; PERSONAL INJURY; BUSINESS INTERRUPTION; SUBSTITUTE SERVICES; OR OTHER LOSSES ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEWAY’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO HOMEWAY FOR THE SERVICES IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.
THE LIMITATIONS ABOVE APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Homeway, qLabs LLC, and their owners, officers, employees, contractors, affiliates, agents, service providers, and licensors from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
You may stop using the Services at any time. We may suspend, restrict, downgrade, or terminate your access to the Services or your account at any time if we believe you violated these Terms, created risk, failed to pay, abused the Services, caused unusual costs, or if continued service is no longer commercially, legally, technically, or operationally reasonable.
Upon termination, your right to use the Services ends immediately. We are not obligated to maintain, export, or return data after termination except where required by law.
We may update these Terms from time to time. The updated Terms will be posted on this page with a new “Last Updated” date. If we make material changes, we will use reasonable efforts to provide notice, such as through the website, email, or account notice. Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the Services and cancel any subscription.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except to the extent federal law applies.
Please read this section carefully. To the maximum extent permitted by law, you and Homeway agree to resolve disputes through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless another arbitration provider is required by law. The arbitration will take place in King County, Washington, unless the arbitrator allows remote proceedings or applicable rules require otherwise.
YOU AND HOMEWAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, account security, system security, or unauthorized access.
Homeway will not be liable for delay, failure, interruption, or unavailability caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet failures, infrastructure failures, cloud-provider outages, third-party service failures, denial-of-service attacks, malware, security incidents, government actions, legal requirements, power failures, payment-processor issues, or other events outside our reasonable control.
These Terms, together with any policies referenced in them, are the entire agreement between you and Homeway regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or operation of law.
